Terms of Use

The terms that govern the website, the NotchNook app and the licenses we sell.

Effective date: November 4, 2026

These Terms of Use (the Terms) govern your access to the website at getnotchnook.com, the NotchNook application, and related materials (together, the Services). The Services are operated by lo.cafe Ltda., CNPJ 35.124.367/0001-00, Brazil (lo.cafe Ltda., we, us, or our).

NotchNook is published by lo.cafe Ltda., which answers for the Services under these Terms.

By downloading, installing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

01What we offer

Prices and currencies are shown for the selected offer before purchase and must match the checkout. Existing campaigns, discounts and subscription price-lock conditions remain those agreed at purchase.

02Eligibility and permitted use

You may use the Services only in compliance with applicable law and these Terms. You are responsible for the devices, operating system, internet connection, and backups necessary to use the application.

03Software license

Subject to these Terms and any applicable license terms delivered with the software, lo.cafe Ltda. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use NotchNook on Mac devices that you own or control, solely for personal or internal business use.

You may not, except where applicable law prohibits a restriction:

  • copy, modify, translate, or create derivative works of the software;
  • reverse engineer, decompile, disassemble, or attempt to derive its source code;
  • rent, lease, sell, sublicense, distribute, or make the software available to others;
  • remove proprietary notices or circumvent security, activation, or technical restrictions; or
  • use the Services to interfere with, damage, or gain unauthorized access to systems or data.

04Purchases, licenses, trial and refunds

Classic retains its existing 48-hour trial, including trial resets with feature updates, and the existing allowance of up to 30 days between successful license validations. Earlier purchase terms remain applicable.

NotchNook Pro 2.0 includes a 48-hour trial inside the application. Updating or reinstalling the app does not restart that trial.

A NotchNook Pro 2.0 license can be activated on up to two Macs. Version 2.0 uses its own licenses; a version 1 license does not activate version 2.0.

Classic and Pro are separate products with separate licenses. Existing Classic licenses and subscriptions remain valid under their original purchase terms. Purchasing Pro is optional and does not cancel a Classic subscription.

An internet connection is required for activation and periodic license validation. Offline access depends on the latest successful validation and ends when that authorization or the trial or subscription period expires.

For new NotchNook Classic or Pro purchases directly through Stripe under these Terms, you may request a full refund within 7 days by emailing support@getnotchnook.com. Refunds go to the original payment method and cancel the corresponding license. Purchases made under an earlier refund promise retain that promise. Paddle purchases follow Paddle’s applicable refund policy, including any longer period, and mandatory consumer rights remain unchanged.

A monthly subscription renews until cancelled. You can cancel Classic or Pro yourself at any time in the billing portal at getnotchnook.com/billing, signing in with your purchase email; if you cannot access the portal, contact support@getnotchnook.com. Cancellation stops future renewals and access continues until the end of the paid period.

05Installation and Apple notarisation

NotchNook is distributed outside the Mac App Store, signed with a Developer ID certificate and notarised by Apple. The first time you open it, macOS verifies the download and asks you to confirm that you want to open it; the download page explains the steps. The only official download is the one published on getnotchnook.com. Copies obtained elsewhere are not ours, are not checked by us, and are not covered by these Terms.

06Updates and changes

We may update, modify, suspend, or discontinue any part of the Services. An update may be required for continued compatibility, security, or operation. We do not promise that a particular feature, version, integration, or service will remain available.

07Intellectual property

The Services, including their software, design, content, logos, names, and other materials, are protected by applicable intellectual-property laws. Except for the limited license above, these Terms do not give you any ownership interest or other right in the Services or our intellectual property.

NotchNook, lo.cafe and the related names, logos and visual elements are trademarks and intellectual property of lo.cafe Ltda. All rights reserved. They may not be used without prior written permission, except for fair and lawful references to the product.

08Feedback

If you send us suggestions, ideas, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, and incorporate that feedback without compensation or obligation to you.

09Third-party services

The Services may link to or interoperate with third-party software, websites, or services, including the payment processor used at checkout. Those third parties are responsible for their own offerings and terms. We are not responsible for third-party content, availability, or practices.

10Disclaimers

THE SERVICES ARE PROVIDED AS IS AND AS AVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LO.CAFE LTDA. DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, compatible with every device or macOS version, or free from harmful components.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

11Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LO.CAFE LTDA. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES.

Where liability cannot lawfully be excluded, lo.cafe Ltda.'s aggregate liability for all claims arising from the Services is limited to the amount you actually paid to lo.cafe Ltda. for the Services during the twelve months before the event giving rise to the claim. If you paid nothing, lo.cafe Ltda. has no liability, to the maximum extent permitted by law. This limitation does not apply where applicable law prohibits it, including mandatory consumer-protection rules.

12Indemnity

To the maximum extent permitted by law, you will indemnify and hold lo.cafe Ltda. harmless from claims, losses, liabilities, and expenses arising from your unlawful use of the Services or breach of these Terms.

13Termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk for the Services or others, or are required to do so by law. On termination, the license granted in Section 3 ends.

14Governing law and disputes

These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules. Any dispute will be submitted to the courts with jurisdiction at lo.cafe Ltda.'s legal domicile, except where mandatory consumer-protection law provides otherwise.

15Changes to these Terms

We may revise these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Your continued use after they take effect constitutes acceptance to the extent permitted by law.
